Complain for some collective measures at Rinasi police commissariat addressed to the Ombudsman

Honoured Ombudsman!

Based on two complains received in the address of Albanian Police Union and more concretely the complain by Deputy/commissar Jonida Burba, in the function of boot controller at Rinasi police commissariat which at the same time is the General Secretary of the Union and the complain of Deputy/commissar Hatixhe Dulellari in the function of boot controller in the same commissariat we are asking your support and urgent intervention near the General Director of State Police, Mr. Hysni Burgaj and the Minister of Interior, Mr. Bujar Nishani to react towards the Decision nr. 44,dt. 18.05.2012 given by the Appeal Commission at the General Directorate of State Police for collective disciplinary measures ” For rank reduction for 6 months” for the above mentioned police employees ( where for an unproven case 8 police employees were punished at the same time)

These measures were openly contrary with the Disciplinary Regulation approved by a CMD nr. 786,dt.04.02.2008, exactly the article 27, point 3, letter c for ” the ongoing of the disciplinary documentation” of police employees and in the same article point 5, letter c, which foresees that the recommendation for disciplinary measures needs to contain documents which prove facts and datas for individual responsibility. The disciplinary practise executed by the Directorate of Professional Standards for the above mentioned police employees leads to misinterpretations up to abuse.

According to written documents at our disposal it results that the disciplinary measures to their address are not argumented and not at all convincing. We as a Union do consider these collective measures as an open infringement to the rights of police employees which do not aim to the solution of  the case but on contrary to protect the real authors of the infringements at Rinasi airport thus resulting to the moral disparagement of police employees not included in this illegal activity. We have to quote out that these measures effect them on economical basis as well but also they have the impact on their carrier ongoing not enabling them to apply for higher ranks.

Apart our persistence to avoid the police employees from those disciplinary measures to whom the infringement is not proven, as an individual responsibility based on standard working procedures approved with normative acts, this was not taken into consideration by the Appeal Commission, leaving in power the given measures.

Attached you will find a copy of the decision for disciplinary infringement given by the General Director Mr. Hysni Burgaj based on the Final Report of the Professional Standards Directorate nr. 529/8, dt. 18.04.2012 and a copy of the decision of review complaints from the Appeal Commission for Disciplinary Measures at the General Police Directorate.
